Terms of Sale
These Terms of Sale govern purchases made directly from Aurora Digital Design LLC and should be read together with the applicable product listing, product license, Privacy Policy, and Digital Product & Refund Policy.
1. Scope
These Terms of Sale apply to purchases made directly from Aurora Digital Design LLC through its website or through a checkout process identified as an Aurora transaction. Third-party marketplace purchases may also be governed by the marketplace’s terms.
2. Products and Digital Delivery
Product listings describe the primary contents, file types, sizes, formats, license level, and other material characteristics of each product.
Digital products are delivered electronically using the method stated at checkout or in the order confirmation. No physical shipment is provided unless the product listing expressly states that a physical item is included.
3. Orders
Submitting an order is an offer to purchase under the terms displayed at checkout. An order may be rejected or canceled before fulfillment where reasonably necessary because of fraud concerns, payment failure, material pricing error, product unavailability, technical error, legal restriction, or other legitimate reason.
If Aurora cancels a paid order before fulfillment, the amount collected for that canceled order will be refunded as appropriate.
4. Pricing and Payment
Prices are displayed in the currency shown at checkout and may change without notice for future purchases.
Payment may be processed by a third-party checkout or payment provider. Customers agree to provide accurate billing and transaction information and to comply with the provider’s applicable terms.
Applicable taxes may be calculated, collected, or remitted by Aurora or a marketplace/payment provider as required by law.
5. Digital Delivery
A digital product is considered delivered when the download, access link, account access, or other electronic delivery mechanism is made available to the purchaser, subject to applicable law.
Customers are responsible for maintaining access to their purchase confirmation and for downloading and securely storing purchased files within any stated access period.
6. License to Use Purchased Content
Purchase grants only the license expressly associated with the product. Unless expressly stated otherwise, ownership of copyrights, trademarks, source files, and other intellectual-property rights remains with Aurora Digital Design LLC or the applicable rights holder.
Customers must comply with the Personal Use, Commercial Use, Extended Commercial Use, or product-specific license associated with the purchase.
7. Customer Responsibilities
Before purchase, customers should review:
- Whether the product is digital or physical;
- Included file types and dimensions;
- Software, account, printer, device, or technical requirements;
- Editing capabilities and limitations;
- License type and usage restrictions;
- Number of included files or pages; and
- Any product-specific instructions or limitations.
8. Editable Products
Products described as editable are editable only to the extent stated in the listing. Some elements may be fixed, flattened, locked, platform-dependent, or require third-party software or accounts.
A customer’s inability to edit an element that the listing clearly identified as non-editable does not make the product defective.
9. Color and Print Variations
Colors may vary between monitors, devices, software, paper, inks, printers, and professional print providers. Minor color variation is not necessarily a product defect.
Customers are responsible for selecting appropriate print settings, paper, scaling, and printer capabilities unless Aurora expressly provides a different guarantee.
10. Refunds and Cancellations
Refunds, cancellations, duplicate purchases, download issues, and digital-product remedies are governed by Aurora's Digital Product & Refund Policy and applicable law.
11. Chargebacks and Payment Disputes
Before initiating a payment dispute for a technical, delivery, or product issue, customers are encouraged to contact Aurora so the issue can be investigated and reasonably resolved.
Nothing in this section waives a customer’s lawful right to dispute genuinely unauthorized or improper charges.
12. Product Changes and Updates
A purchase includes the product as described at the time of purchase. Aurora may update, revise, expand, discontinue, or replace products in the future, but a prior purchase does not automatically include all future versions, additions, or upgrades unless expressly stated.
13. Personalization and Custom Work
If custom or personalized products are offered, project-specific terms, proofs, revision limits, production schedules, deposits, cancellation rules, and intellectual-property terms may apply in addition to these Terms of Sale.
14. Prohibited Resale and Redistribution
Customers may not redistribute, share, sublicense, upload, resell, or give away Aurora source files or digital products except as expressly permitted by the applicable license.
Commercial-use rights authorize only the uses stated in the applicable license; they do not transfer ownership of Aurora’s underlying intellectual property.
15. Warranties
Aurora warrants that digital products will materially correspond to their descriptions at the time of sale, subject to disclosed technical requirements and ordinary differences in devices, software, printers, and displays.
Except for rights that cannot lawfully be excluded, no additional warranty is created merely because a product is used for a particular personal or commercial purpose.
16. Limitation of Liability
To the fullest extent permitted by law, Aurora's aggregate liability arising from a particular purchase will not exceed the amount paid to Aurora for the product giving rise to the claim, except where applicable law prohibits such a limitation.
Aurora is not responsible for indirect or consequential business losses resulting from a customer's misuse of a product, failure to maintain backups, incompatible third-party software, or use outside the disclosed product specifications, except where liability cannot legally be limited.
17. Governing Law
These Terms of Sale are governed by Missouri law, except where federal law or mandatory consumer-protection law requires otherwise.
18. Changes
Aurora may update these Terms of Sale prospectively. The terms applicable to a completed transaction are generally those presented or incorporated at the time of purchase, subject to mandatory law.
